TERMS AND CONDITIONS OF EXPOMUS WEBSITE USAGE

I. GENERAL CONDITIONS

I.1. The present Terms and Conditions of Expomus Website Usage (hereafter called “Term”) outline the essential and necessary conditions of use by any internet users of the web page of the company called Expomus – Exposições, Museus, Projetos Culturais Ltda. (“Expomus”), whose website is http://www.expomus.com.br (“Expomus site”), including copyright issues, according to the Brazilian law ner. 9.610/98.

I.2. By accessing or using Expomus site, the user agrees to be bound by the present TERM, which governs the relationship between Expomus and the user, including the license to use Expomus site.

I.3. The valid and effective version of the present TERM is the latest posted on the home page of the Expomus site, that governs all prior and contemporaneous agreements between the users and this website, taking into consideration rights and warranties previously granted. The user should review the agreement periodically to be aware of eventual modifications and his continued access or use of the Expomus site shall be deemed his conclusive acceptance of the amended term.

I.4. Expomus site services are free.

II. REGISTER

II.1. To gain access to the content the user may have to register with Expomus site, and some personal information might be required, according to its privacy policy. The access to the areas that do not need registration does not exclude the acceptance of the present TERM by the user.

II.2. All the information that the user provides to Expomus site and its services must be true, and the user is the sole responsible for the accuracy of the fulfilled information in the Expomus site forms. The user must also keep the personal information permanently up-dated. False and inaccurate information constitutes violation of this present term by the user, and consequently he may not access or use Expomus site. In any case, the user is always the sole and exclusive responsible for his action and damages for the Expomus site, regarding Expomus and any third-party linked websites.

II.3. Parents, tutors or legal representatives must provide previous authorization to users that are under 18 years-old to enable them to gain access to Expomus site, and they are responsible for the users acts. Parents, tutors or legal representatives are also liable for the underage´s access to Expomus site, without previous authorization. They are integrally responsible for controlling the activities and acts of their respective minors.

II.4. Expomus site covers the security levels within the legal requirements to keep your personal data safe online, however this protection is not infallible and is subject to violation by different threats.

III. USERS SPACE

III.1. Expomus site may provide online space for blogs, forums or any other means of connection among users.

III.2. The users are entirely responsible for the comments posted on the blog by means of Expomus site or any other place available for them on it.

III.3. The user´s participation on the blog or on Expomus site does not involve any employment, society relationship, neither partnership nor association between the user and Expomus site, and there is no entail that could exempt both from their obligations.

III.4. The author of the content posted on the blog by means of Expomus site may identify himself with his civil name, either complete or abbreviated with its initials, pseudonym or any other conventional sign (Law ner. 9.610/1998, Art. 12). It is not allowed to post contents by unknown author.

IV. PROPERTY RIGHTS OF THE SITE AND RESPECTIVE CONTENTS

IV.1. Expomus is exclusively responsible for the rights to use the contents on the site, as well as their modification, promotion and termination. Some of the posted material, such as texts, images, videos, etc. may be copyrighted by third-parties, and in this case their respective credits are displayed on the site. The use of their logos, marks and signs requires their express prior written permission.

IV.2. The design, production and programming related to the site are the copyrighted work of Tecnopop Comunicação Visual e Multimídia Ltda.

IV.3. The user is authorized to diffuse the contents on Expomus site, ever since its origin is identified and it does not have any commercial purpose or direct benefit, other than informing viewers, and it does not include any of the following items:

a. Pornographic content or illegal activities including users under 18 years old;

b. Rude and offensive content and/or terms;

c. Discriminatory practice, induction or incitation regarding origin, race, ethnic group, sex, sexual orientation, color, age, religious belief or any other kind of discrimination;

d. Calumnious, abusive content, including violation of privacy;

e. Obscene or pornographic images and/or terms;

f. Harmful and defamatory statements;

g. Information on illegal activities and crime incitation;

h. Copyrighted material and/or image;

i. Information on piracy of copyrighted material and property;

j. Third-parties names, contacts and other information;

k. Political publicity for candidates, parties or coalitions, as well as publicity of their agencies or representatives;

l. Promotional banners;

m. Online commerce, even if goods are produced by the page´s author;

n. Software and files containing viruses or any other harmful content.


V. RESPONSIBILITIES

V.1. The user agrees to use Expomus site on good-faith, according to the regulating and contractual legal precepts eventually applicable, and to comply with the public order, the morality and the good manners generally accepted.

V.2. Under no circumstances Expomus site, its authors, editors or maintainers are liable for any damages (including damages for loss of profit) or otherwise, directly or indirectly, arising from the use by its users, viewers or any other person of its content or of any other listed or linked third-party website.
V.3. All Expomus site services are free to use by the visitors. Therefore, the user may access, use and print out material from the site exclusively for personal purposes. The user may not copy, distribute, transmit, display, reproduce, modify, publish, license, adapt, post and/or use on another internet page, transfer or sell any information, software, users list or other lists, products or services available on Expomus site, for commercial purposes without Expomus previous permission.

V.4. Expomus shall not be liable for any user´s content, opinions and comments on the Expomus site.

V.5. Expomus shall not be liable for any damage supposedly arising out of the use of Expomus site, included any sites listed or third-party linked websites on Expomus site.

V.6. Expomus may, in its discretion, terminate or deny access to and use of the website, if the user breaches this agreement, and he will be liable for unlawful acts.

V.7. Services on Expomus site do not have a predetermined duration, and Expomus reserve the right in its sole discretion, without any obligation and without any notice requirement to the user, to terminate or delete all or any part of documents, information or other content appearing on the site, as well as to modify them completely.


VI. GENERAL

VI.1. All actions or proceedings arising directly or indirectly out of this agreement, or the use of the site shall be litigated in the circuit court of São Paulo, SP exclusively.
